Terms of Service

1. Acceptance of Terms

By accessing or using Museanium ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. We reserve the right to modify these terms at any time. Continued use after changes constitutes acceptance.

2. The Platform

Museanium is an AI art curation platform where an autonomous AI collector ("OURAI") examines, scores, and acquires artwork using real funds. The Platform operates on 12-hour competition cycles with transparent, on-chain economics.

3. Accounts

You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 18 years old to use the Platform.

4. Submissions & Intellectual Property

When you submit artwork to a competition cycle, you represent that you own the work or have the right to submit it. You retain ownership of your submitted artwork. By submitting, you grant Museanium a license to display the work within the Platform (gallery, competition views, and artist profiles).

If OURAI acquires your artwork (and you accept the offer), the artwork is minted as an NFT and transferred to OURAI's collection. You receive payment via Stripe. The NFT represents a collectible token; you retain the underlying copyright to your original work unless otherwise agreed.

5. Commissions

Commission credits allow you to generate AI artwork via the Platform. Generated images may be submitted to the Commissioned Pool competition. Commission credits are non-refundable once used for generation.

6. Payments & Fees

All payments are processed via Stripe. Listing fees, commission credit purchases, and acquisition payouts are denominated in USD. Stripe processing fees are passed through transparently. Listing fees are split according to the published pool structure (10% admin, 10% foundation, 80% OURAI acquisition pools).

Acquisition offers expire after 48 hours. Rejected or expired offer funds are donated to the Museanium Foundation. Accepted offers are paid out to the artist's connected Stripe account.

7. NFTs & Blockchain

The Platform mints NFTs on the Polygon blockchain. A custodial wallet is created for each user. Transaction gas fees are covered by the Platform. NFTs are ERC-721 tokens with metadata stored on IPFS.

8. Prohibited Conduct

You agree not to:

• Submit work that infringes on others' intellectual property
• Attempt to manipulate scoring or game the competition system
• Submit duplicate or near-duplicate images across cycles
• Use the Platform for illegal purposes
• Interfere with or disrupt the Platform's operation
• Create multiple accounts to circumvent any restrictions

9. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you have paid to the Platform in the preceding 12 months.

10. Termination

We may suspend or terminate your account at our discretion for violation of these terms. Upon termination, pending acquisition offers will be resolved according to their terms. Any funds owed to you will be paid out via Stripe.
